Welcome to fitnesSociety. These Terms of Service ("Terms") govern your use of the mobile fitness application (the "App") operated by fitnesSociety ("we," "us," "our," or "the App"). By using the App, you agree to these Terms, which constitute a binding agreement between you and fitnesSociety.
fitnesSociety provides workout and meal plans as a resource for our users. By using our app, you acknowledge and agree that fitnesSociety will not be liable for any injury, illness, or other adverse effects that may result from following our workout or meal plans.
Our workout and meal plans are intended to be used by individuals who are physically capable of engaging in physical activity and following a specific diet. However, if you have any pre-existing health conditions or injuries, it is essential to consult with your healthcare provider before beginning any workout or meal plan.
Additionally, our workout and meal plans are for informational purposes only and should not be considered medical advice or a substitute for professional medical treatment or advice. fitnesSociety does not guarantee any specific results from following our plans, and individual results may vary.
By using our app, you assume full responsibility for any risks, injuries, or damages that may result from following our workout or meal plans. fitnesSociety will not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to your use of our app or any of our workout or meal plans.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. You may not copy, modify, distribute, sell, or transfer any part of the App or its content without our prior written consent.
You may need to register for an account to access certain features of the App. You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree to notify us immediately of any unauthorized use of your account or breach of security.
You agree not to:
• Use the App for any illegal or unauthorized purpose
• Modify, adapt, or hack the App or its content
• Transmit any viruses, worms, or other malware
• Interfere with or disrupt the App or its servers
• Impersonate or misrepresent your affiliation with any person or entity
• Violate any applicable laws, rules, or regulations
We reserve the right to suspend or terminate your access to the App if you violate these Terms or engage in any other conduct we deem harmful to the App or its users.
fitnesSociety owns all rights, titles, and interests in the App and its content, including all intellectual property rights. You may not use the App or its content except as expressly authorized by these Terms or by us in writing.
The App is provided "as is" and without warranty of any kind. We do not warrant that the App will be uninterrupted or error-free, or that any defects will be corrected. We disclaim all warranties, express or implied, including without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement.
fitnesSociety will not be liable for any damages, including without limitation, direct, indirect, incidental, special, consequential, or punitive damages, arising out of or in connection with the use or inability to use the App or its content, even if we have been advised of the possibility of such damages. Your sole remedy for dissatisfaction with the App is to stop using it.
We may terminate these Terms and your access to the App at any time for any reason. All provisions of these Terms that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
We may update these Terms from time to time, and the updated version will be posted on the App. Your continued use of the App after the changes take effect constitutes your acceptance of the updated Terms.
These Terms and your use of the App shall be governed by and construed in accordance with the law, without giving effect to any principles of conflicts of law. Any disputes arising out of or in connection with these Terms or the App shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between you and fitnesSociety with respect to the App and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us.
